It wouldn't necessarily be that night's minimum, but the first temperature below 40 WOULD be 39.

NYC's first 30's was today...The latest date that happened was on 11/15/1938...The earliest was 9/30/1912...1965 was 10/5...1964 was 10/6...1974 was 10/3...1947/1992 was 10/1...1977 was 11/12...1898 was 11/11...

Temperature is a continuous curve. There is no possible way for it to go from 40 to 38 in an instant.

That said, this is a pretty petty argument in the first place. Who cares?

tonight will be 39. drier air moving in, but winds should keep things above guidance.
